All businesses will provide references for ex-employees at some time. What do you do if potentially negative factors come to light after an employee has departed but before the request for a reference? In a recent case , it was upheld that the “old employer” was right to bring the issues to the attention of the “new employer” but on the basis that they were allegations only, they had not been investigated because the employee had left and therefore they couldn’t be substantiated.
